These Terms and Conditions govern your use of the Donal Digital Academy online learning platform at training.donaldigital.com, including the creation of a student account, enrolment in any course, and use of any platform features.

By creating an account or enrolling in a course, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use this platform.

 

NOTE

These Terms and Conditions govern the Donal Digital Academy course platform specifically. Separate Terms and Conditions govern bespoke service engagements with Donal Digital at donaldigital.com.

1. Definitions

• “Academy”, “we”, “us”, or “our” refers to Donal Digital Academy, operated by Okey Chigbu trading as Donal Digital, Lagos, Nigeria
• “Platform” refers to the online learning platform at training.donaldigital.com
• “Student” or “you” refers to any individual who creates an account or enrols in a course on the Platform
• “Course” refers to any online learning programme, module, or educational content available on the Platform
• “Content” refers to all video lessons, documents, worksheets, quizzes, and other materials within a Course
• “Certificate” refers to the digital certificate of completion issued on successful completion of a Course

2. Account Registration

To access paid courses on the Platform, you must create a student account. By registering, you agree to:

• Provide accurate, current, and complete information during registration
• Keep your account credentials secure and not share your login with any other person
• Notify us immediately at [email protected] if you suspect unauthorised access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that provide false information, share access with others, or violate these Terms.

3. Course Enrolment and Access

3.1 Enrolment

Course enrolment is confirmed upon successful payment. You will receive immediate access to the enrolled course upon payment confirmation. Free courses are accessible upon account registration without payment.

3.2 Course Access

Upon enrolment, you are granted a personal, non-transferable, non-exclusive licence to access and view the Course Content for your own personal learning and non-commercial purposes. This licence does not permit you to:

• Share your account or course access with any other person
• Download, copy, reproduce, or distribute Course Content in any form
• Use Course Content for commercial purposes — including reselling, repackaging, or teaching others using our materials as your own
• Record, screen-capture, or extract video lessons or materials from the Platform

3.3 Access Duration

Unless otherwise specified on the course page, your access to enrolled courses is lifetime access — meaning it continues for as long as the course remains available on the Platform. We reserve the right to retire or update courses and will provide reasonable advance notice if a course is to be removed.

4. Fees and Payment

4.1 Course Pricing

Course prices are displayed in Nigerian Naira (NGN) on each course page. Prices are inclusive of any applicable fees. We reserve the right to change course prices at any time. Price changes do not affect courses you have already purchased.

4.2 Payment Processing

All payments are processed through Paystack. By making a payment, you also agree to Paystack’s terms of service. We do not store your payment card details. You are responsible for ensuring payment details are accurate and that sufficient funds are available.

4.3 Promotional Pricing

We may from time to time offer promotional or discounted pricing. Promotions apply only for the period specified and may not be combined with other offers. Promotional prices are not available retrospectively to students who purchased at full price.

5. Refund Policy

5.1 Standard Refund Window

You are entitled to a full refund if you request it within 14 days of enrolment and have completed less than 20% of the course. This policy reflects our confidence in the quality of our courses while protecting the investment of time put into creating them.

5.2 How to Request a Refund

To request a refund, email [email protected] with your name, the course name, your account email address, and the reason for your request. We will process eligible refunds within 5 working days of approval. Refunds are returned to the original payment method used.

5.3 Non-Refundable Circumstances

Refunds are not available in the following circumstances:

• More than 14 days have passed since enrolment
• You have completed 20% or more of the course content
• The course was purchased at a heavily discounted promotional price of 50% off or more
• You have already received a refund for a previous enrolment in the same course
• The course was a free enrolment

6. Certificates

Upon completing 100% of a course’s required lessons and assessments, a digital certificate of completion is automatically generated and made available in your student dashboard. Certificates:

• Are issued in your registered name — ensure your name is correctly entered in your account profile before completing a course
• Include the course title, completion date, and Donal Digital Academy branding
• Are for personal use — you may share them on LinkedIn, include them in your CV, or use them as evidence of skills with clients or employers
• Are not academic or government-recognised qualifications — they are professional development certificates from a private training provider

If your certificate contains an error due to our mistake, contact us and we will issue a corrected certificate at no charge.

7. Intellectual Property

7.1 Our Content

All course content on this platform — including video lessons, written materials, worksheets, quizzes, graphics, and platform design — is the intellectual property of Donal Digital / Okey Chigbu, protected under Nigerian and international copyright law. All rights are reserved.

7.2 Your Licence

Your course enrolment grants you a personal, non-exclusive, non-transferable licence to access and use the course content for your own learning. This licence does not transfer any ownership of the content to you.

7.3 Prohibited Uses

You may not, without our prior written permission:

• Reproduce, copy, or distribute course content in any medium
• Create derivative works based on course content
• Use course content to teach, train, or instruct others commercially
• Upload course content to any third-party platform
• Remove or alter any copyright notices, branding, or attribution from course materials

Violation of these intellectual property terms may result in immediate account suspension and legal action.

8. Acceptable Use

By using this platform, you agree not to:

• Attempt to gain unauthorised access to any part of the platform or other students’ accounts
• Use automated tools, bots, or scripts to access, scrape, or extract platform content
• Upload or transmit any malicious code, spam, or harmful content
• Impersonate any other person or entity
• Use the platform for any unlawful purpose
• Circumvent or attempt to circumvent any platform security measures or content protection

We reserve the right to suspend or permanently terminate accounts that violate these acceptable use conditions, without refund.

9. Platform Availability

We strive to keep the platform available at all times but cannot guarantee uninterrupted access. The platform may be temporarily unavailable due to maintenance, hosting issues, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by platform downtime.

We reserve the right to modify, update, or discontinue any part of the platform or any course at any time. Where a course is to be permanently removed, we will provide reasonable advance notice to enrolled students.

10. Limitation of Liability

10.1 No Guarantee of Outcomes

Course content is provided for educational purposes. Donal Digital Academy does not guarantee specific career outcomes, income levels, business results, or skill acquisition timescales as a result of completing any course. Results depend on each student’s effort, application, and individual circumstances.

10.2 Maximum Liability

To the maximum extent permitted by Nigerian law, Donal Digital Academy’s total liability to any student for any claim arising from or related to the Platform or course content shall not exceed the total amount paid by that student for the specific course to which the claim relates.

10.3 Exclusion of Consequential Loss

Donal Digital Academy shall not be liable for any indirect, consequential, or special losses, including but not limited to loss of income, loss of business opportunity, or loss of data, arising from use of or inability to use the Platform.

11. Third-Party Links and Tools

Some courses may reference or recommend third-party tools, platforms, or services. These references are made for educational purposes only. Donal Digital Academy is not responsible for the availability, accuracy, terms, or practices of any third-party service. Use of third-party tools is at your own risk and subject to their own terms of service.

12. Changes to These Terms

We may update these Terms and Conditions as the platform grows. When material changes are made, we will update the effective date and, where appropriate, notify enrolled students by email. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms and Conditions are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria. Both parties agree to first attempt amicable resolution of any dispute before initiating formal legal proceedings.
